Subdivision and Development Appeal Board (SDAB)
Members
The Village of Alberta Beach currently utilizes seven certified SDAB Board Members and two certified SDAB Clerks.
Responsibilities
The Subdivision and Development Appeal Board (SDAB) is an impartial, local quasi-judicial authority that hears appeals of decisions made by the Development Officer, Subdivision Authority, or regarding development permits and stop orders issued by the municipality.
Meetings
The SDAB meets only when an appeal is received. Meeting dates, times, and locations are advertised with at least five (5) days’ notice. Meetings are open to the public; however, the SDAB deliberates and makes its final decision in private.

Who Can File an Appeal?
Development Permit Appeals
- Your application has been refused.
- Your permit was approved with conditions you find unacceptable.
- A stop order has been issued against your development.
- You will be affected by a new development or use on another property.
- The Development Authority fails to make a decision within 40 days of receiving your complete application.
Subdivision Appeals
- Your subdivision application has been refused.
- Your subdivision was approved with conditions you find unacceptable.
- The Subdivision Authority fails to make a decision within 60 days of receiving your application.
Only the applicant (or agent), Village Council, a provincial department, or a school board may appeal a subdivision decision. Neighbours cannot appeal a subdivision application.
Stop Orders
Under Section 645 of the Municipal Government Act (MGA), a stop order may be issued when a development, land use, or building use does not comply with a bylaw, development permit, or subdivision approval.
Affected Persons
An affected person is generally someone who owns property, carries on a business, or resides in the vicinity of a proposed development. A person who only visits the area does not qualify as an affected person.
Appeal Deadlines
Appeals must be submitted within 21 calendar days of notification of a decision or order.
Subdivision Appeals: within 21 days of the date the decision is mailed.
Development Appeals: within 21 days of the date the decision is received.
Stop Order Appeals: within 21 days of the date the decision is received.
Appeals can be submitted by mail to Box 278, Alberta Beach, Alberta, T0E 0A0, by email to aboffice@albertabeach.com, or delivered in person to 4935 – 50 Avenue, Alberta Beach, Alberta.
Appeal Process
- A Notice of Appeal and applicable appeal fee must be submitted at the time of filing.
- The appeal must include a written statement outlining the reasons for appeal.
- The SDAB must hear the appeal within 30 days of submission.
- A public hearing will be scheduled, with written notice sent at least five (5) days prior to thehearing date to the appellant and affected persons.
- If you are unable to attend, contact the SDAB Clerk to request rescheduling.
Appeal Hearing
- Appellants (or their representatives) are expected to make a verbal presentation to the Board.
- Written submissions to be included in the agenda package must be received five (5) working days prior to the hearing by mailing to Box 278, Alberta Beach, AB T0E 0A0, by email to aboffice@albertabeach.com, or delivering in person to 4935 – 50 Avenue, Alberta Beach.
- Large submissions presented at the hearing may result in a postponement to allow adequate review.
- The Board will focus only on relevant planning matters during the hearing.
- The SDAB will issue a written decision with reasons within 15 days of concluding the hearing.
